Unreasonably Delayed Immigration Applications and Writs of Mandamus
When your case has stalled, a federal court can order a decision.
OVERVIEW
Some applications sit with USCIS or a consulate far past normal processing times with no answer. When inquiries and other steps have failed, a writ of mandamus is a lawsuit in federal district court asking the judge to order the agency to decide your case.
A mandamus suit does not guarantee approval. It gets your case decided. The suit must be filed in the right court, after other options have been tried, or it can be dismissed. We review your timeline first and file when the delay justifies it.
